📜  An influx of tenders were published ahead of the Procurement Act 2023's go-live date

Analysis from Tussell shows the volume of new tender notices spiked in the days before the Procurement Act went live.

Whilst the number of tender notices published each week has yet to return to pre-Procurement Act levels, the number of new Preliminary Market Engagenent (PME) Notices has bounced back quickly.

For suppliers, this should be taken as an early indication of an increased public sector focus on pre-tender market engagement.

Keeping track of PME Notices and attending Preliminary Market Engagement events is a great way of shaping future tender criteria and networking with key stakeholders.

For buyers, these events help to foster innovation, encourage SME and VCSE participation, and can be a valuable tool for developing appropriate social value scoring for the procurement.

 

📊  23% of above-threshold notices used the Competitive Flexible Procedure

Tussell's analysis shows that the Competitive Flexible Procedure (CFP) is already being utilised regularly in above-threshold public sector procurements.

For buyers, the Competitive Flexible Procedure allows for a more flexible multistage approach to procurement that permits the inclusion of negotiation, site tour, or dialogue stages.

The new procedure type empowers buyers to tailor their bidding criteria and produce procurements that truly deliver for local people. If any procurement teams have yet to try out the new procedure type, now could be a good time to give it a go.

For suppliers, high usage of the CFP makes it more important than ever to read through tender documents in full when making bid/no bid decisions.

All stages included in the Competitive Flexible Procedure will be laid out within the tender documentation and can be read ahead of bid submission.

 

🌱  Over 5% of FTS notices refer to procurements being reserved for SMEs/VCSEs

The Procurement Act grants public sector contracting authorities new powers to reserve specific procurements for VCSEs, SMEs and local suppliers.

For SMEs and VCSEs, this is encouraging news. 

Even if procurements are not reserved for SMEs, buyers are taking action to increase the participation of small businesses in public procurement.
